Police charged Southold resident Ryan Lademann, also 26, with second-degree assault, a felony, at about 9:45 p.m. for allegedly shooting his friend, Lukasz Pasko, in the neck with a rifle at Mr. Lademann's Pine Neck Road residence, police reported.
Officers on the scene said they found Mr. Pasko, a 2002 graduate of Southold High School, on a couch with a gunshot wound on the left side of his neck, not breathing but with a pulse. Southold Fire Department rescue workers responded, treated and took him to Eastern Long Island Hospital. He was then taken to Stony Brook University Medical Center, where he was listed in critical condition, Southold Town Police Capt. Martin Flatley said. Pasko died on Saturday.
Capt. Flatley described the incident as "more of an accident." Mr. Lademann, a 2002 graduate of Mattituck High School, told police he was cleaning his gun and it accidentally discharged.
There were witnesses in the room who confirmed that Mr. Lademann was "cleaning the gun or taking it apart" before the shooting took place, Capt. Flatley said. He added that an accidental shooting that causes serious injury is considered "reckless" and fits into a section of law that qualifies it for the felony charge.
Mr. Lademann was held overnight at police headquarters and arraigned on Sunday before Judge William Price, who released him on his own recognizance.
The district attorney's office "recommended $250,000 bail," Capt. Flatley said, adding that he believed the district attorney was looking for a grand jury indictment but "that all depends on Mr. Pasko's physical condition. And it does not look good."
A prayer Mass was held for Mr. Pasko Monday night at Our Lady of Ostrabrama R.C. Church in Cutchogue.

Well, that was before mr pasko died. they should arraign him again on new charges and throw the book at him. rumours have been flying around town (as they usually do, which i won't publicize here since they are not confirmed) but if certain ones are true, then he should be locked up for several years...

I can't believe I'm actually posting a comment on here. I'm generally not the kind of person to respond to blatant garbage on the internet. However, I am posting this time to ask of Mr. Schmidt and the other various gun-control critics, to please keep your political passion and personal opinions to yourself at this time. There are friends and family that most likely have come across this article and these insensitive comments. I do agree with the fact that this accident was a direct result of irresponsibility...the gun should have been checked for remaining rounds. HOWEVER, this is simply not the time to offer your two cents. There are people experiencing more pain than most of you can ever imagine...I certainly can not fathom how it feels to lose a family member. Just remember people: Sko was somebody's child. Somebody has lost their child and must deal with that for the rest of their time on this earth. Do them a favor and give them their initial grieving time before you provide us with your "insight" into what went wrong, who's to blame, etc. It's simply not appropriate right now.

This is a newspapers website, not a blog.. for anyone who did not know Lukas nor knows Ryan, they are both GREAT guys. It is very unfortunate that Skos life was taken by such a horrible ACCIDENT, but that's all it was. The two of them were best of friends. The assumptions and comments being made on here are just ridiculous and so low. Lukas will be forvever missed and loved and Ryan is still in our prayers.

for all of you bashing the man who served and protected our country and fought for your right to insult him can and should just stop right now. im wiling to bet that most of you have never even held or fired a weapon so to think you are inclined to refute the points of a man who has dedicated his life to protect and serve others is garbage. you want to talk to him, grab a gun and stand a post and defend the men and women at your side with your life as they put their lives in your hands and then you will have the right and privilege to speak to him, until then save the breath that he provides you. this is a very sensitive issue to both of our communities, i have known ryan since i was 5 years old and i know this action was not premeditated in any way shape or form but the fact is still that not all the necessary precautions were taken, if you really cared about the people involved in this then you would not be fighting while an innocent and young man is fighting for his life. thoughts and prayers to all those effected by this horrible tragedy.

all i would like to say is please stop all of this back and forth bickering. it isn't helping anyone and if anything it is making a bad situation worse. many many people were affected by this tragedy and although people think they are just stating facts or trying to make a point, they are taking away from the one person who needs us the most. Lukas and his family and friends need our support and help. what they don't need is a public debate on gun safety. so all i ask is keep your opinions and feelings to yourself. keep in mind that anyone can read this including the family and friends of those involved. so put yourself in their place, would you want a horrible family tragedy turned into an online arguement?

The infinite insight and pearls of wisdom written in all caps (shared here) have convinced me that sharing safety rules on a reckless discharge NEWS (and therefore public) article is viewed as wrong. How dare someone who knows how to use a weapon try to prevent another tragedy! What has America come to?!
What we should all take away from this?..after taking "IGNITION OUT OF THE GUN, THERE COULD STILL BE UNKNOWINGLY ONE IN THERE" and that no one has a right to judge or comment NEWS articles....except me

I have to agree that severe negligence was done here. From an objective point of view, this was a major mistake and the law should be upheld. Friendships, emotions, relationships mean nothing when a mistake is made that harms or takes someone's life. This Matthew Schmidt is speaking with concise moral bearing and not berating anyone on these comments (the way the others are berating him).
No matter what occurred or who is your friend or otherwise, a bullet should not discharge from a weapon unless it is intentional.

I think what started this whole line of back and forth comments is that fact that people are pleading that Lademann not be charged at all. I think people can all agree that it was a tragic accident and both of these guys are going to be scarred for life (physically & mentally), however, looking from an outsiders point of view, regardless of the friendship, in court you would have to prove no negligence on Lademann's part, which would be tough to do. accidents do happen, but even so, if you had some kind of control over the situation (keeping the gun empty, not even bringing it out while others are around, etc), then you do need to answer for what you've done. not being there, it's impossible to assume what happened, however, it seems that Lademann had a lapse in judgement when he handled his gun, but that is for a judge to decide.

Just to clarify for all of those who like to gossip. It was NOT a drug deal gone wrong. It WAS three friends hanging out. There was no drug bust, it had NOTHING to do with guns. Ryan was set to leave for the Army so the guys got together for a night of friendship before he left.

I would like to start off and say that all of my thoughts, prayers, love, and wishes go out to Lukas and Ryan during this difficult time. I am proud to call them my friends and stand by them both. I love you guys.
Now, I realize this isn't a social networking site, but I need to get this off my chest.
Matt Schmidt- I think you need to get off your high horse and stop acting as if you know everything. No one cares what you know about guns. You must not be able to read or your ignorance is even greater than your lack of sensitivity because it clearly says that it was an ACCIDENTAL shooting. Please keep your thoughts and comments to yourself. As far as telling Kyle that he has to right to say anything because of mistakes he's made is absolutely mind blowing. You have no idea what Kyle feels or thinks. What he has done in the past does not mean that he cannot feel strongly for his friends and want to stand up for them. Kyle is a good person, it is you that I am not so sure about.
For everyone else reading this-Lukas and Ryan are both great people and they need your love, support, and prayers now more than ever. They have both lost so much by this tragedy and need all the hopeful wishes they can get.

People should keep such hurtful thing's to themselfs in consideration of all the people who are effected from this.second off some action should be taken on the local shooting range that sells illegal hollow point rounds that made the damage to lukas so bad.And most important everyone keep praying for Lucas he's such a great ,strong person.

Have to luv how everyone in the small town arena where "everybody THINKS they know your name" jumps on the bandwagon when a tragedy strikes. Not considering the feelings, emotions nor the facts worsens an already tragic situation. Half stories are printed because they leave doubt. Doubt leads to assumption of wrongdoing. Wrongdoing is heehaw big news out here considering this "big news" is usually related to leaves falling or a branch in the road. And experts will say it's not an accident a bullet was left in a guns chamber nor should it have been pointed at someone. These are true to a degree! Ryan was going into the Army to serve. Likely he would end up in Afghanistan in harms way but he is not a soldier yet. I've been in bootcamp and there have been many stories how the rifle was pointed the wrong way without thinking. How there was ammo in the mag. If he was jokingly aiming the rifle there would be no hope right now. This was an accident. Tragic. What these families do not need is going off half-cocked like this rifle did with half stories, half truths and without a sincere half a care except exciting news in a town where there isn't much except town hall meetings and occasional DWI's for the most part of which we should all be thankful for. Get a grip and show support. Words kill worse sometimes than guns. But what can I say... How typical!

I won't be hurt if anyone bashes me but I just wanted to leave a comment to say a few things. I have my freedom of speech- might as well use it. It pretty much appalls me that this is all even being discussed as comments on a news article. Save that for facebook or twitter or any other social site you use. We are talking about the lives of two individuals as the result of a tragic accident. Rather than sitting here bickering on a news article- we should be coming together and praying (and for those of you who don't believe in prayer) or hoping that this situation turns around for the better. We have Lukas laying in a hospital bed surrounded by people who love and care about him hoping and praying for a miracle that he pulls through. And on the other hand, we have an individual-Ryan, whose life will be forever changed by this incident (I can't imagine what you are going through- but hang in there and know that you have plenty of love and support). Both of them and their families need all the prayers and support they can get. So why don't we be a little more humane and put ourselves in those shoes. Who cares about how stupid or irresponsible you think a person was. Too bad. These are lives we are talking about. So please quit the bickering and posting of things that you would be better off saving for your myspace. My thoughts and prayers especially go out to Lukas Pasko and his family- they need a miracle. The fact that you would take this opportunity to write bullet points about gun safety telling people to contact their Congressman and make presumptions about those involved is beyond reprehensible. How dare you even address Kyle or suggest that you know a damn thing about his emotions or objectivity. Your statements portray an ignorance of the highest magnitude with regard to human dignity. I hope that I never see you around town again because I'm ashamed to share the same streets with you. How utterly heartless. 1. I never said that someone didn't know how to use a gun, I simply stated that the safety rules were not followed.
2. I would re-teach a sergeant who blew his finger off with a gun how to follow proper safety rules. I've done it with people before and I am sure I will do it again. Which brings me to my next point...
3. I have taught classes on this subject, in fact I have done it for years, since it was my profession and all.
4. Obviously you cannot unload a gun and leave a mysterious bullet, since at that point, it would not be unloaded. The only way a round can be left in the gun is if you fail to clear the chamber, which is step one of unloading a weapon.
5. I make sure that no one who hasn't had proper training touches my weapons. Only I hold those combination. I also would never allow. like any responsible adult, a weapon that is not currently being fired, to be loaded. Also if they shot themselves, I of course would be sad, but it would not be an accident. I lost a very close friend to a self inflicted negligent discharged and I felt the same way then as I do today. Just because you love someone doesn't mean they cannot be wrong.
6. At no point did I ever say anything negative about anyone involved, in fact I believe that I made it perfectly clear that no one should prematurely judge the accused.
7. If you do not have as much knowledge about weapons as I or many other people in this community have, you sound ignorant when trying to "educate" us.
8. As far as accidents go, whether it be in a car or with a gun; If every person in the world did what they were supposed to do when they were supposed to be doing it these types of accidents would not occur. It only takes one person being reckless for these accidents to occur, and in this case that person was the accused.
You cannot argue basic facts. Kyle, what you wrote was completely based on the emotion you feel about the situation. The emotions do not allow you to look at the situation objectively. The fact that I am not close to any of the parties is exactly what makes me a commentator. I never claimed to be a player. Anyone who actually takes the time to read and comprehend my posts will see that they are filled with information that may possibly prevent future events like this from occurring. If simple facts and common sense offend anyone, then maybe you shouldn't venture into the outside world. While many are coming to the defense of Mr. Lademann and getting upset over people's comments on a website. you seem to forget that he is not the victim, Lukas Pasko is.

Please stop turning this into a name calling situation or a Facebook page. This is our hometown’s newspaper and shouldn’t turn into this.
I know of each individual, but I was not there that night. I’ve been away from Southold for some time and was horrified when I heard of this incident. I have seen many presumptions from many posts over the last week of what could have happened, or what might have been involved, or who is to blame. From what I have read from THIS ARTICLE, I have my opinion and it’s on what Capt. Flatley stated, “…an accidental shooting that causes serious injury is considered "reckless" and fits into a section of law that qualifies it for the felony charge.” This statement is the law and incorporates both the words accidental and reckless, which both occurred that night.
Lucas, I hope you pull through and continue to live your life. Ryan, I know you will never forget that night. You will learn from this and be a better person but what has happened has happened. We must move forward. If or when Ryan must stand trial, I hope our judicial system will give him a fair trial, innocent until proven guilty of whatever is charged against him. This is my opinion, everyone has one, please do not bash and point fingers. Thank you.

you people are treating a gun like it's a pencil! you act like someone would say "oh honey, can you hand me my rifle off the coffee table?" when dealing with firearms, they should be in cases or locked safes and brought out carefully to be cleaned and first thing you do is AIM IT AT THE FLOOR AND MAKE SURE ITS EMPTY. especially a rifle, that's bolt action - you slide the bolt back (and if cleaning it, you slide it all the way out) thus the gun cannot fire. who the hell leaves guns lying around anyway, loaded or not? this all goes back to being reckless.

Mr Schmidt is 100% correct. Additionally, you cannot place blame on the goverment for not having enough laws and requiring training. We all had enough "training" to drive a car and yet accidents still happen, that's a given, but think about how accidents are caused - someone is negligent in the care and operation of a device (car, gun, whatever). No one said the bullet came through a window, I asked what if the shot came out of his window and it came into a neighboring house? You might not be aware, but rifles fire extremely long range bullets and last i checked, unless at a firing range, are not allowed to discharge a rifle on Long Island. Which further begs the question, why was it loaded at almost 10pm at night? No one is saying this is not tragic for both sides, however, you cannot negate someone's responsibility just becuase they were friends.

For anyone who does not understand firearms, a few things must occur for a rifle to fire whether it be intentionally or on "accident". First and foremost the weapon needs to be loaded with ammunition, which should be removed before packing the weapon away, with a round in the chamber at the beginning of the barrel, which if the gun is not about to be fired should not be the case. Next, the weapon's safety needs to be disengaged. That safety prevents the hammer inside the gun from being able to engage the primer on the bullet and should be engaged at all times when not about to fire. Lastly, that hammer needs to be engaged either by the pull of the trigger or from a major malfunction (uncommon unless tampering has happened) within the trigger mechanism. Essentially, if any one of these things gets overlooked, disaster can occur. If the witness does not have experience with guns and understand the rules, how can he/she state that Mr. Lademann was following safety procedures? He obviously was not. The gun never should have been loaded and the safety should not have been disengaged allowing the rifle to fire. Whether or not he actually made contact with the trigger or if it "went off", the damage was done the second he thought of bringing that rifle out to clean. The biggest question is how did he plan to clean this gun? A loaded weapon cannot be cleaned since you can not access the barrel or the internal mechanisms of the gun with a round in the chamber. I have seen hundreds of negligent discharges in my life and not one of them was an accident. They were caused by an intention lackadaisical attitude towards the weapon and a unconscious disrespect for the rules. I am 100% certain that Mr. Lademann did not intend to shoot the victim, but his actions and lack of situational awareness directly contributed to the potentially fatal event and for that was arrested. Many people serve jail sentences and feel horribly guilty for their actions. Mr. Lademann may possibly become an example of that. In the eyes of the law, guilty feelings are not enough punishment. Victims don't usually have the option to drop felony charges against a friend. Although Dick Cheney got away with a very similar incident, the victim in that case had very minor injuries. Plus as we all now know, Mr. Cheney appears to excel at getting himself out of sticky situations. Unfortunately for Mr. Lademann, he does not hold as much clout as the former VP. This case needs to be examined and leniency should not be tolerated, nor should he be convicted before having his day in court. Maybe our gun laws should be changed, but don't write to me or to this message board, write to your Senators and Congress-people. Thank you.

By the way, just to clarify: the shot did not fire through a window. And my understanding that the other friend who was present is that Mr. L was following safety precautions but obviously something went wrong. Maybe a shot was mistakenly left in the chamber and the gun malfunctioned, I don't know. Like I said, I don't know anything about guns, but I think you should consider that it might not be as black and white as you say, especially given that you don't have any personal information about the incident.

You wouldn't be saying that if was your accident or it the accident of your child who hurt someone else. We are all capable of making mistakes, with a gun or whatever, and we all do. seems like our (scarce) government resources should be spent on protecting us from people who are intentionally hurtful. I don't know anything about guns, nor do I want to, but I know that we are all human and there was no intention to hurt his dear friend. Maybe it would be more productive to revisit our gun laws. Maybe people should be required to complete safetly training before being able to purchase a firearm. Nonetheless, I don't believe for an instant that the young boy whose life is in critical condition would want his lifelong friend to be sent to jail. May God watch over Mr. Pasko and his family. They do not want vengence, why do you?

This is crazy! Let him off? He wasn't out in the woods hunting and an accident happened! Common sense says you should never have a loaded rifle sitting in your home. And when you go to clean it (at 9:30pm) the first thing you do is make sure the chamber is empty. You wouldn't be saying the same thing if the bullet came through your window and hit one of your loved ones. Unfortunately, Mr Pasko is suffering right now becuase of his friend's recklessness.

Irresponsibilty: so maybe we should put our energy into having the laws changed to require training before firearms can be purchased; but to arrest this man for a felony (a lifelong friend of the victim) for an accident adds a tradgedy on top of a tragedy. He's undoubtedly already living his own personal hell since what happened. I would prefer to see our tax dollars spent prosecuting people who hurt others with malicious intent . Did Dick Cheney get arrested or tried when he "accidentally" shot his friend? No. While I respect your perspecitve as an infantryman, the training you received is not the same training regular people are required to have to own a gun. People are human and all make mistakes. There is no such thing as an accidental discharge of a firearm; there is only a failure in training and safety. I served in the United States Marines Corps as an infantryman and have extensive experience shooting as well as teaching young men and women to master these tools. When a person takes the responsibility of wielding such awesome power as that of a gun, they have to respect that weapon and truly understand the power of life and death. These are your weapons safety rules: 1) Treat every weapon as if it were loaded. 2) Never point your weapon at anything you DO NOT intend to shoot. 3) Keep your finger off the trigger until you are ready to fire. 4) Keep the weapon on safe until you intend to fire. If only one of these safety rules is broken, dangerous and unnecessary events can occur. Unfortunately, a person purchasing a gun is not required to know this information. I hope for both an honest and fair process for Mr. Lademann. Most importantly, my most positive wishes go out to Mr. Pasko and his family. There is an entire community rooting for you. Get well.
