ROCHA, DEFENDANTS, STATE OF NEW YORK) ) SS: COUNTY OF SUFFOLK) By virtue of a certain execution issued upon a judgment in the SUPREME COURT, COUNTY OF SUFFOLK STATE OF NEW YORK, and to me directed and delivered against certain real property therein described, I have seized all the right, title and interest which the Defendant D&T UNIQUE CARPENTRY & DESIGN INC. had on the 29TH DAY OF FEBRUARY 2008, or any time thereafter, of in and to the following described property, to wit: ALL that certain plot, piece or parcel of land, lying and being at East Marion, Town of Southold, County of Suffolk and State of New York, known as and by Lot 42 as shown on a certain map entitled, "Map of Highpoint at East Marion, Section Two" and filed in the Office of the Clerk of the County of Suffolk on 07/13/1984 as Map No. 7755, File No. 9640 and being bounded and described as follows: BEGINNING at the corner forming the intersection of the southwesterly side of Cedar Drive South and the westerly side of Oak Court, said corner having a radius of 25.00 feet and a length of 35.74 feet and from said point of beginning: RUNNING THENCE southerly along the westerly side of Oak Court, along an arc of a curve bearing to the right having a radius of 595.00 feet, a distance of 133.44 feet; THENCE south 89 degrees 17 minutes 10 seconds west, 256.73 feet; THENCE north 24 degrees 11 minutes 50 seconds west, 21.39 feet; THENCE north 97 degrees 07 minutes 20 seconds east, 259.89 feet to the southwesterly side of Cedar Drive South; THENCE along the southwesterly side of Cedar Drive South the following two (2) courses and distances: (1) South 52 degrees 52 minutes 40 seconds east, 26.50 feet; (2) THENCE southeasterly along an arc of a curve bearing to the right having a radius of 330.00 feet, a length of 97.28 feet; THENCE southeasterly along the corner first above-mentioned having a radius of 25.00 feet, a length of 35.74 feet to the point or place of BEGINNING. TOGETHER with all right, title and interest of the party of the first part, in and to the land lying in the street in front of and adjoining said premises. Which I shall expose for sale by public vendue as the law directs on the 26th DAY OF AUGUST, 2008, at 11:00 a.m. in the forenoon of that day in the Auditorium, Suffolk County Sheriff's Office, 360 Yaphank Ave., Yaphank, Suffolk County, New York. TERMS OF SALE: Payment by cash, certified check, money order, bank check or Attorney's check. Bank checks to be made payable to Sheriff of Suffolk County (and include or yourself).
